Which South Carolina Court Handles a Guardianship Case

The court with authority over a guardianship depends on who the ward is. Only the Family Court can appoint a guardian for a minor, defined as an individual under 18. When the proposed ward is an adult the court finds to be incapacitated, the matter goes to Probate Court. The Sumter County Probate Court handles guardianships of incapacitated adults and conservatorships of both adults and minors.

Guardianship and conservatorship are distinct appointments. Guardianship addresses personal decisions: where the ward lives and what medical care they receive. A conservatorship addresses money, real estate, and property management. One person can serve in both roles, but each requires a separate court order.

The South Carolina Guardianship Petition Process

A probate guardianship begins when a petitioner files a summons and petition with the Probate Court in the county where the allegedly incapacitated person resides or is present. If that person has been committed to an institution by court order, venue also lies in the county where the committing court sits. The court then schedules a hearing and requires medical evidence of incapacity before deciding whether to appoint a guardian. Depending on the circumstances, the court may appoint a guardian ad litem to advocate for the alleged incapacitated individual’s best interests. That appointee must hold a license in law, social work, nursing, medicine, or psychology, or have completed court-approved training.

South Carolina law also directs courts to consider what the law calls a “least restrictive alternative” before granting full guardianship. The court looks first for arrangements that preserve a person’s self-determination, such as supported decision-making or limited guardianship, and can order full guardianship only when those alternatives aren’t sufficient to meet the person’s needs. Whether a hearing, guardian ad litem, or medical examiner is required in a specific case is determined by the court, not fixed in advance.

Guardian Responsibilities & Ongoing Court Oversight

Once appointed, a guardian decides where the ward will live and makes provisions for the ward’s care, comfort, and maintenance, including health care decisions. The role carries ongoing accountability: a guardian must file a report with the Probate Court at least annually on the ward’s condition.

Bonds are generally not required for guardianships but are required for conservatorships, which involve managing money or property on the ward’s behalf. Families considering both roles should understand that distinction before petitioning the court.

Full guardianship isn’t always necessary. An adult with a valid living will, health care power of attorney, or durable power of attorney sufficient to address their needs generally doesn’t require a Probate Court guardianship.
